Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your access to and use of SkyeInsight ("the Platform"), operated by Silverarc Media. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Access & Authorization

The Platform is a restricted-access service. Access is granted solely by invitation from the Platform administrator. You agree to:

• Use the Platform only for its intended purposes
• Keep your login credentials secure and confidential
• Not share your account with unauthorized individuals
• Notify the administrator immediately of any unauthorized access

3. Acceptable Use

You may not:

• Attempt to access the Platform without authorization
• Extract, scrape, or bulk-download data from the Platform
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use the Platform for any unlawful purpose
• Redistribute, sell, or sublicense access to the Platform or its data
• Introduce malicious code, viruses, or other harmful material

4. Confidentiality

All data, analytics, reports, and insights accessed through the Platform are confidential and proprietary to Silverarc Media. You may not disclose, distribute, publish, or reproduce any Platform content without prior written authorization.

5. Intellectual Property

The Platform, including its software, design, algorithms, data models, and content, is the exclusive property of Silverarc Media and is protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you. You are granted a limited, non-exclusive, non-transferable license to use the Platform as authorized.

6. Disclaimer

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that its outputs will be accurate or complete. The Platform's AI-generated analytics and insights are intended for informational purposes only and should not be relied upon as the sole basis for clinical, regulatory, or business decisions.

7. Limitation of Liability

To the maximum extent permitted by law, Silverarc Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of data, revenue, or business opportunities.

8. Termination

We reserve the right to suspend or terminate your access at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Platform ceases immediately and you must discontinue all access.

9. Modifications

We may revise these Terms at any time by posting an updated version on the Platform. Material changes will be communicated to active users. Your continued use of the Platform following any changes constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Massachusetts, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in Boston, Massachusetts.
